Paleo Manila® Service Policy

Please read the following terms and conditions carefully.
By placing an order with us you are agreeing to the conditions that appear below.

 

Who we are. Paleo Manila is a service brought to you by the Threetop Group Ventures INC (TGVI), a corporation duly organized and existing under and by virtue of the Philippine laws with our registered office at the LGI Building, Ortigas Ave. Estension, Greenhills, San Juan City, Metro Manila. By subscribing to use TGVI’s service, a binding contract will be formed between TGVI and the person identified as the client in the order process. 

How to Order. Placing your order could not be easier. To start, all you need to do is create a Paleo Manila Account in our website. We will ask you to provide some personal information including your height and weight, dietary restrictions, medical conditions, food intolerances, delivery and billing information to enable us to successfully provide our service to you. All Paleo Manila subscriptions have to be for a minimum subscription length of 5 DAYS. Please note that we cannot accept orders for less than the minimum subscription of 5 DAYS, as we do currently cater ala carte/per days order yet.

All our slots are on a FIRST COME-FIRST SERVED basis, we have a NO PAYMENT, NO DELIVERY policy to orders without successful or unverified payment. Once we have successfully received payment, we will review your details promptly and you will receive a confirmation of your secured order via email for your desired weeks of booking. (NOTE: We may, under certain circumstances, need to cancel your order and will be informing you of the said changes. We reserve the right to refuse orders from customers at our discretion.)

Your Paleo Manila Plan. There are two options to choose from: REGULAR meal Plan OR PLUS+ Meal Plan. Before you start, we will review the personal information you have provided, to help ensure that you have chosen the correct meal plan, and advise when necessary. Our  Paleo Manila® Starter Kit sets out what you should expect from your Paleo Manila® Meal Plan. We aim to provide nutritionally-balanced meal plans designed for weight loss, general health, fitness and wellness and over-all wellbeing. Paleo Manila® delivers the night before, from 4:00-10:00 PM during Sun-Thu for your Mon-Fri meals. ALL Paleo Manila® Meal Plans are inclusive of delivery charge, and exclusive of weekends.

Allergies? Food Intolerances? Medical Conditions? Special Dietary Needs? Paleo Manila® will gladly FULLY-CUSTOMIZE your meal plans (e.g. NO Pork / NO Beef / NO Chicken / NO Fish / NO Seafood /  Paleo Manila® for Diabetics, etc.) according to your individual needs. Nutritional Advice. Paleo Manila® menus are designed by the team of experts of The Paleo Manila® Team. If you have any questions about the nutritional aspects of this service, please let us know immediately and we shall be happy to discuss these with you. Any nutritional advice must NOT be relied upon as a specific health and medical prescription. For your specific medical conditions, please consult your physician or doctor prior to availing of our service.

Paleo Manila® offers standardized, regulated menus by our in-house nutritionist-dietitians, food scientists and dedicated R&D team. As we rely on fresh seasonal produce, we reserve the right to make any changes to the menus at our sole discretion. While we can cater to clients who have sensitive medical conditions, allergies, dietary restrictions and food intolerances, we recommend you to consult with your nutritionist or doctor for your specific prescription and nutritional requirements. We shall not be liable for any ingredient that causes a reaction. If you are in any doubt of your health, you must see your own nutritionist or doctor as soon as possible.

NOTE: Weight loss results may vary and can be influenced by other factors, including your metabolic rate, energy expenditure, hormonal imbalance, diet (foods you eat other than our meal deliveries) and other preexisting medical conditions.

We highly recommend at least (30) days for full evaluation of the success of your meal plan. Your body has to adjust from fueling itself on high glycemic carbs and processed sugar to burning your stored fat for energy, which can take a few weeks.

Payment. Payment is STRICTLY via our official online payment solution partner, DRAGONPAY through the following means: Credit Card Payment, Online Banking, and Over-the-Counter (OTC) Banking. Click here to read more on how to secure your payment with us.

Paleo Manila® strongly discourages COD payments via check/cash payments upon delivery for your safety and security. We reserve the right to amend or refuse the sale, if the payment received is not correct to our current pricing structure, or if the number of days purchased is below our minimum of 5 days. Before your subscription expires, we shall endeavor to contact you to discuss renewal. If you wish to renew your subscription, we shall again require full payment in advance for subsequent subscription periods of at least (5) further days at a time. If we are not able to contact you before your subscription expires, we will assume that you do not wish to renew the subscription until advised by you.

Please note that prices may alter, and that we reserve the right to change prices without prior notice by amending our advertised price list. This will not affect any subscriptions already paid for in advance.

Deliveries. Paleo Manila® delivers ANYWHERE within Metro Manila and in some areas of Rizal. We will be glad to arrange for delivery to an address different from the invoice address. Please indicate clearly the delivery address and useful landmark/s when placing your order.

If you require us to access secure parts of your home or building in order to deliver your Paleo Manila® meals, please notify us of this at the time of placing your order. We strongly advise to give an authorization letter to the management of the building to notify them that you will be receiving a delivery from us to avoid delay of delivery and spoilage of meals. Please keep us up to date with any changes that might affect our ability to deliver to you, within (24) hours before the day of delivery. If we cannot access your location because of changes that were not notified of, we will attempt to contact you to make other arrangements. If we are unable to deliver in such circumstances, we reserve the right to charge you for that day.

We will deliver your package to you every day of your subscription between the hours of 4:00PM and 10:00PM. Time for delivery shall not be the essence of our contract.

Due to circumstances beyond our control, sometimes our Paleo Manila® riders experience unavoidable delays. In these circumstances we respectfully request that you allow us to deliver until 9:00AM of the following day. In the event that delivery still has not been made or attempted by 10:00PM on delivery days, we will either attempt to deliver again the next morning. We shall not be liable for any non-delivery, even if it is our fault, unless you notify us by telephone by 12:00PM max on the due day.
Please note that we will be allowing MAXIMUM of (1) address change just in case next day meal delivery needs to be delivered to office. Any liability for non-delivery shall be limited to replacing your Paleo Manila® meals within a reasonable time or issuing a credit note to you for that day.

Handling. Upon receipt, your Paleo Manila® meals should be stored in your freezer or refrigerator respectively upon receipt. Cooking and re-heating instructions must be followed closely.

NOTE: Sauce containers are not meant to be heated. Please remove from container and pour onto meals before heating.

The Paleo Manila® Guarantee. It is our intention to give total customer satisfaction through the goods and services we offer. Your Paleo Manila® meal plan should reach you in perfect condition. If you have any concerns with the quality of the meals, please contact us immediately. We shall endeavor to replace the items for your maximum enjoyment. If you do not let us know by 11:59PM on the delivery day of any such problems, we may not be able to refund the item or replace it and you will be deemed as having accepted your package for that day, unless we agree otherwise.

Subscription Periods, Suspension & Cancellation. If you wish to cancel or suspend your subscription, please let us know no later than (2) full working days notice before your meal plan subscription commences.

We highly discourage suspensions or pausing of meal plans to ensure best results. However, due to uncontrollable circumstances, we only permit suspensions once regardless of the meal plan subscription.

All ingredients, supplies are pre-purchased prior to delivery of your meal plan. As such, for requests to CANCEL your subscription later than two (2) full working days before it was scheduled to start, we will endeavor to be flexible and consider your request at our discretion, giving a maximum 50% refund for days not yet taken for the ingredients have already been purchased and an additional of P1,000.00 CANCELLATION FEE for expenditure incurred (such as credit card, banking, administration or courier charges), we reserve the right to make reasonable allowance for this in any rebate that we may agree to make.

For any cancellations or suspensions, you may email us at support@paleomanila.com and we will send a confirmation message to inform you that your request has been acknowledged.

Warranties and Liability. Nothing in these terms and conditions shall:
1. Exclude or restrict our liability for death or personal injury resulting from our negligence or our liability for fraudulent misrepresentation; or
2. Affect your statutory rights if you are transacting as a consumer.
Subject to the above paragraph, our entire liability shall be capped at the sums paid by you for our service during the relevant subscription period. In no event shall we be held liable to you for any special, indirect or consequential damages, loss of profits or goodwill.

Changes to Terms. We reserve the right to make changes at any time to any part of these terms and conditions. All such changes will be published on the website (www.paleomanila.com) and/or shall be sent to you by post or with your packaged deliveries. If you use our website or place any order with us after the changes have been published, you are agreeing to be bound by those changes in respect of that order.

Use of the Website and our Publications. Unauthorized duplication or publication of any materials from our website or elsewhere is prohibited.

Unauthorized duplication or publication of any other materials including but not limited to starter information, worksheets, recipes, brochures, text, graphics, newsletters, the selection and arrangement thereof, and all software compilations, underlying source code and software is prohibited.

You may retrieve and display content from our website on a computer screen and print out individual pages on paper for the sole purpose of placing an order with us or using information for your private, non-commercial purposes in connection with your normal use of our products and services, but all other uses are strictly prohibited except with prior written permission from us. You acknowledge
that Paleo Manila® is our trademark and that you may not use the name.

Choice of Law and Jurisdiction. These terms and conditions shall be governed by and construed in accordance with the Philippine laws. The parties irrevocably agree that the courts of the Philippines shall have exclusive jurisdiction to settle any dispute that may arise out of, under, or in connection with the use of the Website and the purchase of goods from Threetop Group Ventures, Inc. (TGVI), and to submit all disputes to the jurisdiction of the Philippine courts.

General Provisions.
 We shall not be liable for any delay or failure to perform any of our obligations under these terms and conditions due to any cause beyond our reasonable control, including industrial action.

These terms and conditions constitute the entire agreement between you and us and supersede any previous agreement or understanding and may not be varied except in writing between us. All other terms and conditions express or implied by statute or otherwise, are excluded to the fullest extent permitted by law.
 The waiver by us of any breach or default of these conditions shall not be construed as a continued waiver of that breach, nor as a waiver of any subsequent breach of the same or any other provision.

If any provision of these conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these conditions and the remainder of the provision in question shall not be affected.
